1. What you authorize
ⓘ Each time you confirm a payment from your bank, you allow us to take that amount from your bank account.
Adding money to your Cash Plus Account. Funding transfers to India paid directly from your bank. Pay with Xpat purchases from merchants paid from your bank. Scheduled and repeating payments you set up, for each amount and date shown, until you cancel them. Any fees shown to you before you confirm the payment. Recovery debits for any Amount Owed — for example because a debit was returned, a payment was charged back or reversed, or your balance went negative — as described in “Automatic recovery of amounts you owe”. We will tell you the amount and the date of a recovery debit at least 10 days before we make it.
2. Your promises to us
ⓘ You confirm the bank account is yours to use and that there will be enough money in it.
you are an owner or authorized signer on the bank account and have the right to authorize debits from it; the account is a US consumer or business account held in your name (or, for a business profile, in the business’s name), and is not someone else’s account; you will have enough available funds in the account on the date of each debit; you will not ask your bank to return a debit you authorized.
3. Rules that apply
ⓘ ACH payments follow industry rules and US law, and you agree to them.
4. Timing and holds
ⓘ Bank payments take a few business days, and we may hold the money until we know it has cleared.
Money added to your Cash Plus Account from a linked bank is generally available after a hold of about 2 business days. We may make it available sooner at our discretion, or hold it longer if we see a risk of return. For a transfer to India paid from your bank, we may wait until your payment settles before sending the transfer, or send it sooner at our discretion. Sending early is a courtesy: it does not change your obligation to pay. We apply limits to bank-funded payments based on your verification level, account history and risk. Single transfers above ₹5,00,000 must be paid from your Cash Plus Account. A debit scheduled for a weekend or bank holiday is processed on the next business day.
5. If a debit is returned
ⓘ If your bank sends a payment back, you still owe us the money and we will take steps to recover it.

What we may do
Try the debit again. For a return for insufficient or uncollected funds (R01 or R09), we may re-present the debit up to two more times within 180 days, as NACHA allows. We do not re-present debits returned as unauthorized or revoked. Recover the full amount automatically, including any rupees already paid out to your recipient, any money already withdrawn or spent, and any amount credited to your Cash Plus Account, as described in “Automatic recovery of amounts you owe” below. Reverse related credits and rewards, such as Transfer Credit, coupons, scratch-card rewards and referral bonuses tied to the payment. Set off what you owe against any balance you hold with us or any refund due to you. Hold your balance or pending transfers until the amount is repaid. Limit, suspend or close your account, lower your limits, or stop you from paying by bank. Recover any actual third-party or bank charges caused by the return. Xpat does not currently charge its own returned-payment fee; if we introduce one, we will tell you before it applies. Report the return and related account information to fraud-prevention and account-verification services. Pursue collection, including through a collection agency or legal action, and recover reasonable collection costs where the law allows.
6. Automatic recovery of amounts you owe
ⓘ You must pay for every transfer and service we provide; if a payment fails, is returned or is reversed, we recover what you owe automatically, in the order set out here.
Your promise to pay
Your authorization for recovery
Your Xpat balances. We take the Amount Owed from your Cash Plus Account or any other Xpat balance, as permitted by the terms of those accounts, including money that arrives later — such as a direct deposit, an incoming payment, or a refund or reward due to you. We may do this immediately and hold incoming money until the Amount Owed is repaid. Trying a returned debit again. If a debit was returned for insufficient or uncollected funds (return codes R01 or R09), we may present it again up to two more times within 180 days of the original settlement date, as the NACHA Operating Rules allow. A retried debit shows on your bank statement as “RETRY PYMT”. A recovery debit to your linked bank account. For any Amount Owed that remains, we may debit any US bank account you have linked to Xpat for no more than that amount. We will tell you the amount and date of each recovery debit at least 10 days before we make it. You can pay the Amount Owed another way before that date, and we will then cancel the debit. Collection. If the Amount Owed is still unpaid, we may refer it to a collection agency, report it to fraud-prevention and consumer reporting agencies where permitted, and take legal action, and you agree to pay our reasonable costs of collection where the law allows.
